  Measures of Shenzhen Municipality on Promoting Re-employment Subsidies for Persons with Employment Difficulties

  In order to further optimize the employment assistance for people with employment difficulties and promote the employment of people with employment difficulties, According to the Notice of Shenzhen Municipal People’s Government on Optimizing, Adjusting and Stabilizing Employment Policies and Measures to Fully Promote the Development of People’s Livelihood (Shenfu Office Regulation [2023] No.7), the Notice on Printing and Distributing the Guidance List for the Application of Employment and Entrepreneurship Subsidies in Guangdong Province (Revised Edition in 2021) (Guangdong People’s Social Regulation [2021] No.12) and the Administrative Measures on Printing and Distributing the Persons with Employment Difficulties in Guangdong Province,

  I. Definition of Persons with Employment Difficulties

  The term "persons with employment difficulties" as mentioned in these Provisions refers to persons with employment difficulties who have Shenzhen household registration or non-deep household registration in Guangdong Province and whose permanent residence is Shenzhen, and meet the requirements of the Notice of guangdong provincial department of human resources and social security on Printing and Distributing the Administrative Measures for the Identification of Persons with Employment Difficulties in Guangdong Province (Guangdong People’s Social Regulations [2023] No.11) and have been identified by our city.

  Second, the subsidy items and standards

  Since January 1, 2024, the subsidy items and standards for promoting re-employment of people with employment difficulties in our city have been adjusted as follows:

  (A) to absorb social security subsidies for people with employment difficulties

  Employers who recruit people with employment difficulties according to regulations and sign labor contracts with them for one year or more (no time requirement for less than one year from the statutory retirement age)(Except for labor dispatch units), according to the monthly social insurance premiums actually paid by eligible personnel to give social security subsidies.

  (B) social security subsidies for flexible employment

  For employees with employment difficulties who are flexible in employment and participate in enterprise employee pension insurance and employee medical insurance according to regulations, social security subsidies will be given at a rate of two-thirds of their actual contributions per month and not exceeding the standard of 600 yuan.

  (3) Public welfare post subsidies

  The employing units that have placed people with employment difficulties in public welfare posts according to regulations shall be given post subsidies and social security subsidies. Post subsidies are implemented in accordance with the minimum wage standard in our city, and adjusted in a timely manner in synchronization with the minimum wage standard. The social security subsidy standard is based on the social insurance premium actually paid by the employer for eligible personnel every month.

  The employment incentives and post subsidies for employers to recruit people with employment difficulties, as well as the employment incentives and social security subsidies for women over 35 years old (including 35 years old) and men over 45 years old (including 45 years old) who fail to meet the conditions of employment difficulties and have registered unemployment for more than 3 months will no longer be implemented.

  Third, the subsidy period

  Persons with employment difficulties shall enjoy the subsidy policy stipulated in the present Measures for a maximum period of not more than three years. After the expiration of the subsidy period, except for those who are less than five years away from their statutory retirement age from the date when the persons with employment difficulties first enjoy the policy, they may not enjoy the subsidy policy stipulated in the present Measures again.

  Before December 31, 2023, those who are enjoying the re-employment subsidies for people with employment difficulties and still meet the conditions of the original policy can continue to enjoy the original policy until the expiration.

  IV. Subsidy procedures

  To promote the reemployment subsidy for people with employment difficulties, the employer shall apply to the district or street public employment service agency where the registration place is located for social security subsidies and public welfare post subsidies, and the individual shall apply to the district or street public employment service agency where the employment registration place is located for social security subsidies for flexible employment, and the relevant funds shall be charged by the employment subsidy funds in the receiving area.

  (a) to absorb social security subsidies for people with employment difficulties and social security subsidies for public welfare jobs.

  1. apply. Eligible employers shall, within one year from the date of signing a labor contract with persons with employment difficulties, apply for subsidies for the first time to the district or street public employment service agencies where they are registered, and then apply for subsidies for the previous quarter on a quarterly basis in principle.

  2. review. The public employment service institution in the district or street where the registration is located shall complete the post verification and data review within 14 working days after receiving the first subsidy application, and then complete the review within 8 working days after receiving the application for each subsidy. Every quarter after the first post verification, at least one random post verification work shall be completed, and the verification results shall be used as the basis for subsidy payment.

  3. publicity. After the examination and approval, the district or street public employment service agencies shall publicize the subsidy object, subsidy items and subsidy amount according to the regulations, and the publicity period shall be 5 working days. If there is any objection to the publicity, if it does not meet the subsidy conditions after investigation, it will not be subsidized and inform the employer; If there is no objection to the publicity, or if there is objection, but the objection is not established after investigation, it will enter the payment link.

  4. payment. Before the end of the next month after the publicity is passed, the district or street public employment service agencies will issue subsidies according to the regulations and allocate them to the employer’s social security payment bank account.

  5. In case of any of the following circumstances during the subsidy period, the subsidy shall be terminated:

  (1) Failing to pay social insurance premiums for 3 consecutive months due to the employer;

  (2) The social insurance premium is paid by other employers during the subsidy period for those who have been employed and have difficulties in employment (except that the employees move within the group company to which the original subsidy applicant belongs and the name of the employer is changed according to law);

  (3) Post verification found that the actual work situation was inconsistent with the reporting situation.

  The result of termination of subsidies shall be notified to the employer by the district or street public employment service agency.

  (B) social security subsidies for flexible employment

  1. apply. Eligible individuals shall, within one year from the date of employment registration, apply for subsidies for the first time to the district or street public employment service agency where the employment registration is located, and make a commitment to the authenticity of the submitted flexible employment situation, and then apply for subsidies for the previous quarter on a quarterly basis in principle.

  2. review. District or street public employment service agencies shall complete the audit within 8 working days from the date of receiving the subsidy application.

  3. publicity. After the examination and approval, the district or street public employment service agencies shall publicize the subsidy object, subsidy items and subsidy amount according to the regulations, and the publicity period shall be 5 working days. If there is any objection to the publicity, if it does not meet the subsidy conditions after investigation, it will not be subsidized and inform the applicant; If there is no objection to the publicity, or if there is objection, but the objection is not established after investigation, it will enter the payment link.

  4. payment. Before the end of the next month after the publicity is passed, the district or street public employment service agencies will issue subsidies according to regulations and allocate them to personal financial social security card accounts or other financial accounts.

  5. In case of any of the following circumstances during the subsidy period, the subsidy shall be terminated:

  (1) social insurance has been paid by the employer;

  (2) Flexible employment commitment is fraudulent.

  The result of termination of subsidies shall be notified to the applicant by the district or street public employment service agency.

  (3) Public welfare post subsidies

  In accordance with the relevant provisions of the Notice of Shenzhen Municipal Bureau of Finance of Shenzhen Municipal Bureau of Human Resources and Social Security on Forwarding the Administrative Measures for the Development of Public Welfare Posts with Bottom Placement in Guangdong Province (Shen Ren She Gui [2021] No.15).

  V. Supervision and management

  City and district human resources departments should strengthen publicity and guidance, actively push policy information, and improve policy awareness. At the same time, optimize the handling process and information system to improve work efficiency.

  The human resources departments of all districts should fully understand the importance of promoting the re-employment of people with employment difficulties, do a good job in budget planning, strengthen financial guarantee, ensure that the subsidies related to promoting re-employment within their jurisdiction are paid on time and in full, and make overall guidance and supervision of street public employment service agencies in strict accordance with the requirements, so as to improve the actual use of funds.

  The street public employment service agencies should strengthen the acceptance, examination, publicity and distribution of subsidy applications in accordance with the prescribed procedures to ensure the accurate issuance of subsidies; Strengthen the tracking service for people with employment difficulties in the jurisdiction, and provide active employment assistance such as vocational guidance, job recommendation and skill training; Explore effective verification methods to dynamically confirm the authenticity of the re-employment situation of people with employment difficulties.

  The employer or individual shall truthfully fill in the relevant information when applying for the subsidies prescribed in these Measures to the public employment service institutions in the district or street where the place of registration or flexible employment is located. If the employer or individual provides false information to defraud the relevant subsidies, once verified, the district or street public employment service agencies shall immediately stop issuing subsidies and recover the corresponding funds. Those suspected of committing a crime shall be handed over to judicial organs for handling according to law.

  VI. Supplementary Provisions

  These Measures shall be implemented as of January 1, 2024 and shall be valid for 5 years. Notice of Shenzhen Municipal Finance Committee of Shenzhen Municipal Bureau of Human Resources and Social Security on Printing and Distributing Measures for Flexible Employment Subsidies for Persons with Employment Difficulties in Shenzhen (Shenrenshejing [2013] No.8), Notice of Shenzhen Municipal Bureau of Human Resources and Social Security on Matters Related to the Re-application for Employment Subsidies for Persons who Enjoy the Original Employment Assistance Policy (Shenrenshejing [2013] No.9), The Notice of Shenzhen Municipal Bureau of Human Resources and Social Security on Optimizing the Operation Process of Flexible Employment Subsidies (Shen Ren She Gui [2015] No.2) and the Notice of Shenzhen Municipal Bureau of Human Resources and Social Security on Relevant Matters Concerning Employers’ Application for Subsidies and Incentives for Persons with Employment Difficulties (Shen Ren She Gui [2021] No.11) shall be abolished at the same time. "Notice of Shenzhen Municipal Bureau of Human Resources and Social Security on Printing and Distributing the List of Applications for Employment and Entrepreneurship Subsidies in Shenzhen" (No.7 [2021] of Shenrenshejing) is inconsistent with these Measures, and these Measures shall prevail.
